COPYRIGHT VIOLATIONS NOTICE

PrepHeavens Notice for Claims of Intellectual Property Violations

PrepHeavens duly respects the intellectual property of others, and we ask our users to do the same. If you feel that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, kindly provide PrepHeavens Copyright Agent with the following information:

  1. Physical or electronic signature of the person authorized to act on behalf of the owner of the copyright
  2. An account of the copyrighted work or other intellectual property that you feel has been infringed.
  3. A description of where the infringing material is located on the PrepHeavens site or system and supply us with enough details on how we may find it.
  4. Your physical address, postal address, telephone number, and email address
  5. A written statement explaining that you have a good faith belief that the use of the copyrighted material was without the consent of its intellectual property owner, agent, or the law.
  6. A written statement by you, made under penalty of perjury, that the information given in your notice is accurate and that you are the copyright, intellectual property owner or authorized to act on the behalf of either the copyright or intellectual property owner.

Procedure for taking down Materials, Counter-Notices and Notifications

If we receive a proper notice claiming that material provided by you (our subscriber or user) is infringing the intellectual property rights of another party, we will promptly notify you that we have deleted or barred access to the material you provided on our site.

If you believe that PrepHeavens has mistakenly deleted or disabled access to the material, send a counter-notice as described below to PrepHeavens Copyright Agent with the following information.

  1. Either your physical or electronic signature as a subscriber to our services.
  2. A description of the material that has been deleted or access barred.
  3. A description of the exact location on our system the material appeared before it was deleted or access to it barred.
  4. Your physical and postal address, telephone number, and email address.
  5. A written statement by you, made under penalty of perjury, that you have a good faith belief that the material was mistakenly deleted or barred as a result of misidentification.
  6. A written statement that you consent to the jurisdiction of Federal District Court for the judicial district in which you are located, or if you reside outside of the United States, for any judicial district in which PrepHeavens may be found, and that you will accept service of process from the person who provided the original notification claiming infringement or from their agent.

Effect upon Receiving a Counter Notice

When we receive a counter notice as explained above, and in accordance with U.S. copyright law, we will promptly provide a copy of the counter-notice to the person who provided the original notification claiming infringement. We will then inform such person that we will restore the deleted material or stop barring access to it in ten working days. Thereafter, as specified by U.S. copyright law, we will restore the deleted material and stop barring access to it in at most 14 working days following receipt of the counter notice, unless PrepHeavens Copyright Agent first receives another notice from the person who provided the original notification claiming infringement that she/he has filed an action seeking a court order to restrain the PrepHeavens subscriber from engaging in infringing activity relating to the material on PrepHeavens system or network.

In other words?

If you send us a notice claiming infringement in accordance to this policy, we will do everything within our powers to take t down the materials or bar access to them within ten working days. We will also notify our subscriber who originally uploaded the materials on our system and if they respond with a proper counter notice then we will no choice but to restore access to those materials then contact you about it in 14 working days. This can only be stopped if you notify us that you have filed litigation against our subscriber to prevent further infringement.
